The confirmation of your order according to the modalities below defined (See paragraph: "how to place an order?") is worth full and whole acceptance of the present general conditions of sale and use.
You declare you have perfect knowledge and recognize as a consequence that any document in contradiction with these general conditions, in particular, your own general conditions of purchase, has no contractual value and is not opposable to Tahitian Outrigger. The present conditions are modifiable at any time, without advance notice.
The service of online sale is reserved to persons over 18 years old and legally capable of contracting.

The consultation of the site tahitianoutrigger.com is free. All our sections of information, dialogue and reportings, as well as the registration as member to benefit from our offers, invitations or informations are also free.



Article 3: To place an order
To order a product, all you have to do is to select this one and "to click" the button of validation of the order: you fill the ordering form then reach the page relative to payment.
A confirmation of your order will be sent to you after validation of your banking data by the service of secure payment of "La Banque Postale France" or after reception of your banking payment by check or transfer, this document including a number of invoice serving as an invoice. Article 4: Price

For the FRENCH POLYNESIA, no on-line sale is possible. Please address to a local distributor.
For other countries, the total price indicated in the summary of your order, before its definitive confirmation, corresponds to the price of one or several ordered articles, increased by the postage and packing, exclusive of tax and applicable customs duties, that you will have to fulfill at reception of the parcel according to the customs conditions of your country.

An e-mail including a link allowing you to order the article, expenses of delivery included, will then be sent to you within 48 hours.



Article 5: How to pay
You have 2 different ways of payment, offering a maximum of security.
You can pay your purchases:
- By credit card (Eurocard Mastercard, Visa, Credit card) via the service of secure payment of "La Banque Postale France", by indicating your banking address and phone number in compartments foreseen to that purpose.
Your banking address and phone number will never be communicated to Tahitian Outrigger, we shall never ask you, by any means to communicate us your banking address.

- By national and international bank transfer, the necessary information, such as the account number, bank codes, etc. are communicated during the summary of your order. CAREFUL, the orders are only sent at reception of their payment.

Tahitian Outrigger reserves its right to refuse to delivery or to honor an order from a customer who would not have settled totally or partially a previous order or an order witheld until it is administrated.



Article 6: Availability of products
Our offers are valid within the limits of available stocks except opposite mentions indicated in the description of the article and clarifying the nature of the stock and the delay of supply. At reception of your order, we verify the availability of ordered product(s).
In case of unavailability, we promise to get in touch with the customer within three working days to propose him either a new delivery deadline or cancellation of the order.



Article 7: Delivery of the article
The delivery deadline initiates as from the date of the order, if this one is placed before 12 am and if it is a working day.
If the order is placed after 12:00 am and if it is a working day, the delivery deadline initiates the working day following the date of the order.
One or several ordered articles are delivered to the address indicated on the order with an average delay of 3 to 6 days in France, very seldom more than 15 days abroad (according to the address of departure and the destination of the parcel). You have to let the carrier know any reserves (damages) on the contents of the delivery or to inform Tahitian Outrigger by e-mail at tahitianoutrigger@vaatahiti.com within 3 days after delivery.
Tahitian Outrigger would not be considered responsible for the non-performance of the concluded contract in case of force majeure, of fortuitous event, disturbance or all-out or partial strike in particular postal services and means of transportation and\or communication, flood, fire.



Article 8: Correctness of the order
Articles are sold on the site with a detailed description. If a delivered product is not in accordance with the one ordered, such as recapitulated on the delivery note, Tahitian Outrigger promises to exchange or to pay back the product.
To that purpose, you can contact Tahitian Outrigger in tahitianoutrigger@vaatahiti.com to return the involved article within 7 clear days following its reception.



Article 9: Cancellation right
The consumer has a cooling-off period, according to the article L. 131-20 of the Code of the consumption, during a period of 7 clear days as from the reception of the order. He necessarily has to announce beforehand his intention to send the parcel back as part of the course of his revocation right to the mail address of tahitianoutrigger@vaatahiti.com. The delivered products must be returned to Agir Pacific SARL at the expense of the consumer and under its responsibility, he is also responsible to insure the transport, in perfect state of resale, in their original packing. Subject to the respect of the clauses above, Agir Pacific SARL will proceed to the paymentback of products ordered for the amount of the order, except postal charges, within 15 days after reception of the products. No payment back will be done if products are not perfectly intact.

The risks due to transportation are completely at the expense of the sender, and it is up to him to make post haste as for the security of the routing, in particular by insuring its sending. The expenses of return are completely at the expense of the sender, except the case where the return would be motivated by an error of the shop Tahitian Outrigger in the preparation of the order.

In case of defective product the consumer will have to proceed to his return according to the conditions exposed above. The damages meant by a misuse of the product or by an outside reason (such as the non compliance with the conditions of wash!) would not give rise to guarantee. The present general conditions are subjected to the French law. The language of the present general conditions of sale is English. In case of dispute concerning the interpretation or effectuation of the present general conditions of sale, if possible the parties will try to resolve their dispute in an amicable way. In case of failure of these attempts, any contestings that can be given rise to the present general conditions of sale must be hold, even in case of plurality of defendants or appeal of guarantee, in front of the competent courts of Papeete.
